Levels of Manslaughter
There are two types of manslaughter charges, both of which are felonies. Voluntary manslaughter is the charge filed when a person has killed another in the heat of passion, such as in a sudden (but unplanned) fight. As murder charges are related to malice aforethought, a sudden fit of rage when provoked that leads to a death is likely to be charged as voluntary manslaughter.
The potential penalties include up to 20 years in state prison. Involuntary manslaughter is different in that the death occurred unintentionally. This is the charge filed when an act of reckless or gross negligence caused an accident in which another party was killed. To prove that the person was grossly or recklessly negligent, it must be established that the act that led to the death was not what another reasonable person would be expected to do in similar circumstances.
