Protecting Your Child's Best Interest

When parents decide to divorce, many issues will need to be resolved concerning the care and upbringing of any minor children. The issue of custody pertains to both legal and physical custody.

Legal custody is the right to make decisions regarding the child's:

  • Education
  • Religion
  • Healthcare
  • Other important matters

When a spouse has physical custody, he or she provides the child with daily care. Both legal and physical custody can also be awarded to a single parent. In most cases, the court will favor joint custody, however, in which both parents are actively involved in child rearing activities.

Changes in Pennsylvania Child Custody Law

In the state of Pennsylvania, early in 2011, legislation that was a decade in the making officially was passed into law. There are several different aspects of the law, however, one of the most important is that it is believed to turn the law into a more modern interpretation of child custody. For example, decisions regarding custody must now be considered gender neutral.

Other changes include:

  • Judges are now required to provide explanation regarding the decision;
  • There is now a rebuttable presumption that parents be given custody;
  • Notification of relocation is now required; and
  • Criminal history of all household members of custody petitioners be considered

All of these alterations and additions change the way that the game is played – it is vastly important that if you are currently facing a custody battle that you have a divorce lawyer on your side who is up-to-date on all laws and is prepared to provide you with the high-quality and caring representation you deserve.
