Protection from Abuse Act

What is the Protection from Abuse Act?

The Protection from Abuse Act (or PFA) was created to primarily protect women and children from abuse in all intimate relationships. The act mandates that sexual activities must have taken place between the man and the woman involved before an Order of Protection can be issued. Abuse is defined in the act as:

  • Intentionally or knowingly causing bodily injury
  • Putting another in reasonable fear of bodily injury
  • False imprisonment
  • Physically or sexually abusing children considered minors
  • Engaging in continuous acts against a person without proper authority, including following them, that places them in reasonable fear of bodily injury

If you have had an Order of Protection levied against you as a result of the PFA, and feel that you have been wrongly accused and acted upon, contact a York criminal defense attorney who can fight on your behalf with the goal of securing the desired outcome in your case.
